Digital Returns and Complaints

1. Scope and contact

Withdrawal without giving a reason is different from a complaint that Digital Content does not conform to the contract. Nothing limits mandatory Consumer rights.

2. Fourteen-day right of withdrawal

A Consumer may generally withdraw from a paid distance contract for Digital Content within 14 days after the contract is concluded. Sending a clear statement before the deadline is sufficient, and no reason is required.

The statement may be sent by email or through Support. It is helpful to include the name, purchase email, order reference, content name and contract date.

3. Immediate supply of Digital Content

The withdrawal right may end after supply of paid Digital Content not provided on a tangible medium starts only if every statutory condition is met. The Consumer must first actively select one separate, unticked statement:

PirateAC then provides confirmation of the contract and statement on a durable medium. Ordinary acceptance of the Terms, login, file personalisation or technical availability of a download does not replace this process.

If the required conditions were not met, the Consumer retains the withdrawal right and bears no cost for the supplied content to the extent provided by law. The Consumer may always complain about content that does not conform to the contract.

4. Effect of withdrawal and reimbursement

After a valid withdrawal, PirateAC reimburses the amount due no later than 14 days after receiving the statement, generally using the original payment method unless the Consumer agrees to another method without extra cost.

Access to the file or service may be disabled and new downloads blocked. The Consumer must stop using and sharing the content. There is no physical product to return.

Where payment was made on Patreon or through an app store, PirateAC does not issue the refund directly. The request and technical refund are processed under the relevant platform's procedure. This does not limit rights that cannot lawfully be excluded.

5. Digital Content complaints

Digital Content or a digital service should match its description, version, quantity, quality, format, functionality, compatibility, instructions, agreed purpose and required updates.

If it does not conform, a Consumer may require it to be brought into conformity free of charge, within a reasonable time and without significant inconvenience. Where the law permits, the Consumer may then request a price reduction or withdraw, including where conformity is impossible, ineffective, excessively delayed or the lack of conformity is sufficiently serious.

Loss of the ordinary withdrawal right after immediate supply does not remove these conformity remedies.

6. How to submit a complaint

A complaint may be sent to wwwpirateac@gmail.com or through Support. For efficient diagnosis, include where possible:

  • the account name and email;
  • the order or payment reference;
  • the content name, version and format;
  • the device, operating system or application used;
  • the problem and error message;
  • the requested solution.

Do not send passwords, tokens, private keys or other secrets. A receipt is not the only acceptable proof of purchase. PirateAC will acknowledge and answer the complaint within the period required by law.

7. Patreon, cancellation and chargebacks

The user must cancel a subscription through Patreon membership settings. PirateAC cannot cancel it on the user's behalf. Cancellation normally affects the next renewal, and access may continue until the paid period ends according to the status provided by Patreon.

A Patreon refund request must be made through Patreon's procedures. PirateAC does not directly issue refunds of Patreon payments; the request and payment are handled technically by Patreon or the platform used for the purchase. A refund or chargeback may end the related PirateAC entitlement and block further downloads.

A payment dispute is not a substitute for a technical complaint. Making a valid complaint or exercising a statutory right is not abuse.

8. Model withdrawal statement

9. ADR and applicable law

Consumers may seek free help from a Polish municipal or district consumer ombudsman, the Trade Inspection or an appropriate ADR body listed by UOKiK. Polish law applies without removing mandatory Consumer protection in the country of habitual residence.
